By accessing or using SyncNest ("the Service"), operated at syncnest.tv, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

SyncNest is a platform that enables users to watch YouTube videos together in real time. Features include synchronized video playback, live chat, video queues, and community features such as XP and tiers. The Service relies on the YouTube API but is not endorsed or certified by YouTube or Google.

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Notify us immediately of any unauthorized use of your account
• Not create accounts for the purpose of impersonating another person

We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Harass, bully, threaten, or intimidate other users
• Post or share content that is hateful, discriminatory, sexually explicit, or promotes violence
• Spam, flood, or disrupt chat rooms or other users' experience
• Impersonate any person or entity, or misrepresent your affiliation
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use bots, scripts, or automated tools to interact with the Service without permission
• Circumvent any content moderation, bans, or restrictions
• Share copyrighted content you do not have the right to distribute

You retain ownership of content you create on SyncNest (usernames, chat messages, profile information). By posting content on the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Service.

We do not claim ownership of YouTube videos played through the Service. All YouTube content is subject to YouTube's own Terms of Service.

SyncNest uses YouTube API Services. By using the Service, you also agree to be bound by the YouTube Terms of Service. Our use of data from YouTube API Services is governed by our Privacy Policy.

Room hosts and designated moderators may manage their rooms, including muting, banning, or removing users. Platform administrators may take action against users who violate these Terms, including issuing warnings, temporary suspensions, or permanent bans.

We are not obligated to monitor all user content but reserve the right to remove content or restrict access at our discretion.

SyncNest includes a gamification system with experience points (XP) and tiers. These are for entertainment purposes only and have no monetary value. We reserve the right to modify, reset, or remove XP and tier systems at any time.

The Service, including its design, logos, code, and original content, is owned by SyncNest and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written consent.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

We are not responsible for the content of YouTube videos played through the Service, or for any actions taken by other users.

To the maximum extent permitted by law, SyncNest and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service.

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
